Neither Transcontinental Media nor Texas Tourism, Four Seasons Resort (“Contest Sponsors”) will be responsible for late, lost, destroyed, incomplete, illegible or wrongly addressed mail, or the failure or malfunction of any computer software, hardware or telecommunications equipment affecting participation in or any other aspect of this contest.

3. The prize: Three (3) nights’ accommodation for two (2) people and breakfast each morning at the Four Seasons Resort and Club Dallas at Las Colinas, Texas. Accommodation is based on availability and is valid for one year from the contest closing date. Advanced reservation is required. The prize winner and guests are solely responsible for all costs not expressly described herein including, without limitation, transportation to Texas, ground transportation, meals and beverages not otherwise described in the prize description, room service, gratuities, merchandise, telephone calls, tours/excursions, spa services, motorized water sports, telephone calls, in-room movies, mini-bar, insurance expenses of any kind or nature, together with any applicable connector airfare, transfers and/or overnight layover. Contest Sponsors retain the right to substitute components of the prize package. It is the sole responsibility of the prize winner and guests to obtain all necessary travel documentation including, photos, passports and visas, if applicable and to comply with any customs and immigration requirements. Contest Sponsors cannot guarantee that destination airports, coaches, transfer vehicles and accommodations will be wheelchair accessible. Services required for passengers with special needs are not included in the package and may not be available. Travel insurance, including medical insurance, is not included in the package and is the sole responsibility of the passenger(s). Prize winner and guests must travel together on the same itinerary unless otherwise agreed by the Contest Sponsors in their sole and absolute discretion. Minors must be accompanied by a parent or legal guardian at all times. The Contest Sponsors are not liable if travel is impeded or refused by reason of decisions of Canadian or American authorities. Total approximate retail value of the prize is CDN $1,575. The prize must be accepted as awarded and is not transferable or convertible to cash. Contest Sponsors reserve the right, in their sole discretion, to substitute a prize of equivalent or greater value.

4. A random draw - from all eligible entries received on or before the contest closing date will be made at 11:59 PM (EST) on June 6, 2008 in Vancouver. In order to win, the selected entrant must first correctly answer a mathematical skill-testing question and both winner and companion (or their parent/legal guardian if a minor) will be required to sign a standard publicity/liability release confirming compliance with the contest rules and acceptance of the prize as awarded; consenting to the use of their name and photo in any contest-related publicity, and releasing the Contest Sponsors from liability. No substitution for, or transfer of, the prize will be allowed.

5. The contest is open to all residents of Canada, who have reached the age of majority according to the law of the province/territory in which they reside, except employees of Contest Sponsors, their affiliated companies, advertising and promotional agencies and all persons with whom these employees are domiciled.

6. All decisions of the contest judge(s) are final. The chances of being selected depend upon the total number of eligible entries received. This contest is subject to all applicable federal, provincial and municipal laws. Contest Sponsor reserves the right to terminate this contest or to amend the contest rules at any time without notice.

7. All entries become the property of Contests Sponsor and the information on these entry forms will only be used for the purposes of the contest, in accordance with Contest Sponsor’s privacy policy at www.westernliving.com unless entrants otherwise agree.

Contest Sponsors assume no responsibility for lost, stolen, delayed, damaged or misdirected entries or for any failure of the website during the promotional period, for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, access providers, computer equipment, software, failure of any e-mail or entry to be received by Contest Sponsors on account of technical problems or traffic congestion on the Internet or at any website, or any combination thereof including any injury or damage to an entrant’s or any other person’s computer related to or resulting from playing or down loading any material in the promotion. Contest Sponsors reserve the right, in its sole discretion subject to the approval of the RACJ, to cancel or suspend the e-mail portion of this contest should a virus, bug or other cause beyond the reasonable control of Contest Sponsors corrupt the security or proper administration of the contest. Any attempt to deliberately damage any web site or to undermine the legitimate operation of this promotion is a violation of criminal and civil laws, and should such an attempt be made, Contests Sponsors reserve the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution. Entries are subject to verification and will be declared invalid if they are illegible, mechanically reproduced, mutilated, forged, falsified, altered or tampered with in any way.
